1. These terms and eligibility
These terms govern your use of foiawarfare.com and its services, operated by FOIA Warfare LLC, a Nevada single-member limited liability company. By using the service, you agree to these terms. If you do not agree, do not use the service. Applicable consumer rights still apply.
You must be at least 18 and have legal capacity to use the service and enter these terms. This requirement does not mean we verify age at signup. Availability can be limited during early access or depend on your account, feature and agency.
2. The service and our role
Our available tools help identify agencies, draft FOIA (5 U.S.C. 552) and Privacy Act requests, prepare fee-waiver and expedite explanations, score drafts, create PDFs, and track cases and correspondence. Some retained features support state or local public-record requests, draft appeals and user-reviewed email replies. Availability of one tool does not promise coverage of every agency or jurisdiction.
The user is the requester and subject of record for requests for their own records. FOIA Warfare acts as the user's authorized representative and delivery address when an authorized filing or delivery feature is available and the user has granted the required authority. This is administrative representation, not legal representation. Public-record requests do not necessarily concern records about the requester.
Initial authorized filing, USCIS API filing and FOIA.gov submission are planned features, not presently offered by these pages. When live, they will require the appropriate user authorization and may involve human handling of agency requirements. Preparing a draft is not proof that it was sent, accepted or fulfilled. These pages do not establish USCIS approval or availability of any government API.
We are not a law firm and give no legal advice. Using the service creates no attorney-client relationship. Consult a licensed attorney about legal strategy, eligibility, immigration consequences or court proceedings.
3. Your information, review and authorizations
Provide truthful, accurate information and use only records and personal information you are entitled to supply. Review generated requests, recipients, citations, fees and replies before approving use or sending. You are responsible for the truth of statements you make, including any declaration under penalty of perjury or certification for expedited processing. AI-generated declaration text is not your signature or proof that your identity has been verified.
We do not sign personal sworn statements for you. Do not impersonate a records subject or claim authority you lack. Filing or release authority requires the relevant separate approval; merely accepting these terms is not that approval. These terms do not offer a third-party-subject signing or guardian workflow.
Follow agency instructions and any tasks or approvals assigned to you. Agency deadlines and information shown by the service can be incomplete or wrong. Check important dates and confirmation of sending or receipt. When authorized handling becomes available, our assigned work and your required actions will depend on the feature and authorization; you remain responsible for timely responses to requests for your review.
4. Accounts and acceptable use
Keep your account email and sign-in methods secure, provide accurate account details, and tell support@foiawarfare.com about suspected unauthorized access. You are responsible for activity you authorize through your account.
Do not use the service for unlawful requests, fraud, impersonation, harassment, unauthorized access or disclosure, malware, interfering with the service, or bypassing access, rate or payment limits. Do not submit content you lack permission to provide. We may moderate public submissions and restrict accounts that misuse the service.
5. Charges and subscription renewal
Stripe handles payment. Review the price, currency, billing interval, included allowance and any charges displayed before completing a purchase. Our service charge is separate from government search, copying or other agency fees. We do not promise a fee waiver or an agency result. You pay agency fees directly; we do not hold or advance them.
The retained checkout supports monthly and annual subscriptions. If you purchase one, you authorize recurring charges for its stated interval until it is canceled. Actual purchase terms and billing confirmations determine your price and paid period. We do not publish proposed future per-request or pack prices here as current offers.
A planned move to per-request purchases does not itself change an existing subscription or create usable pack credits. Existing paid periods and refund commitments remain subject to the terms given at purchase. Any transition requires separate notice and billing details.
6. Cancellation, refunds and payment disputes
Use the Billing Portal in Settings where available to manage or cancel a subscription, or contact billing@foiawarfare.com for help. The portal confirmation states when cancellation takes effect. We do not promise that every cancellation waits until the period ends. Check the confirmation and contact billing if renewal remains unresolved.
Account deletion includes a billing cleanup step. For the Stripe customer linked to your account, we first expire every open Stripe Checkout session, then cancel every subscription that is not already canceled or incomplete_expired. Cancellation is immediate and without proration. If billing cleanup fails, we return a retryable error and do not delete the account. You can retry or contact billing@foiawarfare.com. Deletion does not issue a refund.
For refund requests, duplicate charges or service problems, contact billing@foiawarfare.com. We honor refund commitments already made at purchase and applicable mandatory refund rights. We do not add an automatic money-back guarantee, refund deadline or prorated refund promise in these terms. Cancellation or an agency releasing no records does not by itself issue a refund. Our payment integration records refunds after Stripe issues them; planned credit restoration for an unsent request is not a current automated remedy.
A payment dispute can remove paid access and request allowances. Later subscription events do not automatically restore that access, and loss of access does not establish cancellation at Stripe. Contact billing@foiawarfare.com to review billing or access problems; these terms promise no automatic restoration timeline.
7. Your content and our intellectual property
You retain any rights you hold in the information and documents you provide. You grant us a limited permission to store, copy, process and transmit that material to provide the service you request, including drafting, case handling, authorized delivery, support and related operational diagnostics. The privacy policy describes processing and retention, including request-derived internal information. This permission is not a blanket authorization to publish your private records.
FOIA Warfare retains rights in its software, branding and service materials. You may use documents generated for you for your requests and related purposes. We do not guarantee that AI output is unique, copyrightable or exclusively yours. Rights in government records and third-party material remain governed by applicable law and any existing rights. Public comments you submit may be displayed with your chosen name after moderation.
8. Privacy and account deletion
Our privacy policy explains collection, AI and other providers, cookies, analytics and retention. Accepting these terms is not a separate filing or records-release authorization. You can use account deletion in Settings and send privacy requests to legal@foiawarfare.com. For a linked Stripe customer, we complete the billing cleanup described in section 6 before deleting the account; failure in that cleanup returns a retryable error and leaves the account in place. Deletion can still fail at other steps or leave case text, files, logs, billing records, public comments, vendor copies and backups. Case archive is not erasure, and agency records are outside our account-deletion controls.
9. Service limits and disclaimers
AI can produce incorrect citations, agency details, summaries or procedural guidance. Scores assess drafts; they do not predict agency outcomes or provide legal opinions. Agencies control acceptance, timing, fees, exemptions and release decisions. We do not guarantee records, a response time, a successful appeal or a filing free of immigration or other legal consequences.
To the extent permitted by applicable law, the service is provided as available and as is, without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, merchantability or noninfringement. Links and connected providers have their own terms and can change or become unavailable. These limits do not remove obligations we expressly undertake for an available authorized service or rights that applicable law does not allow us to exclude.
10. Limitation of liability
To the extent permitted by applicable law, FOIA Warfare LLC is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from the service. Our total liability for claims arising from the service is limited to the greater of $100 or the amount you paid us for the service in the 12 months before the event giving rise to the claim.
These limits do not apply where applicable law prohibits them and do not waive nonwaivable consumer rights or liability that cannot lawfully be limited. The disclaimer uses this same limitation by referring to these terms; it does not impose a separate exclusion of all damages.
11. Suspension and termination
We may restrict or end access for misuse, security concerns, payment problems or legal requirements, and may change or discontinue features. You may stop using the service and request account deletion. Suspending service access does not itself cancel billing or erase retained data. Account deletion follows the billing cleanup in section 6. Purchase commitments and mandatory rights still apply; contact support for access issues and billing for charges or cancellation.
12. Governing law and disputes
Nevada law governs these terms, subject to applicable law and mandatory protections where you live. Disputes may be brought in Nevada state courts or federal courts located in Nevada that have jurisdiction, unless applicable law provides a different forum. You may contact legal@foiawarfare.com to discuss a dispute. These terms do not require arbitration, impose a mandatory waiting period or waive class-action rights.
13. Changes to these terms
We will post revised terms with a new effective date and provide notice or obtain agreement when required by applicable law. Changes do not silently withdraw refund commitments for earlier purchases or grant filing or release authority. No fixed advance-notice period or automatic retroactive acceptance is promised.
